Chapter 1. General Provisions
Article 1 (Purpose)
The purpose of these Terms is to set forth the conditions and procedures for the use of all services (hereinafter referred to as the "Services") provided by ActRO (hereinafter referred to as the "Company") on its website.
Article 2 (Definitions)
The definitions of the terms used in these Terms are as follows:
1. User: A person who receives the Services provided by the Company in accordance with these Terms.
2. Use Agreement: An agreement concluded between the Company and a User in connection with the use of the Services.
3. Registration: The act of completing the Service Use Agreement by entering the relevant information in the application form provided by the Company and agreeing to these Terms.
4. Member: A person who has registered as a member by providing the personal information required for membership registration on this site.
5. User ID: A combination of letters and numbers chosen by the User and approved by the Company for the purpose of identifying the Member and enabling the Member's use of the Services.
6. Password: A combination of letters, numbers, and special characters set by the User to protect the Member's information.
7. Termination of Use: An expression of intent by the Company or a Member to terminate the Use Agreement after the use of the Services.
Article 3 (Effect and Amendment of the Terms)
If a Member does not agree to the amended Terms, the Member may request withdrawal (termination) of membership. If the Member continues to use the Services without expressing an intent to refuse for more than seven (7) days after the effective date of the amended Terms, the Member shall be deemed to have agreed to the amendments.
(1) These Terms take effect by being posted on the service screen, the notice board, or otherwise announced.
(2) The Company may amend the contents of these Terms when deemed necessary, and the amended Terms shall be announced on the service screen. If a User continues to use the Services without expressing an intent to refuse for more than seven (7) days after the announcement, the User shall be deemed to have agreed to the amendments.
(3) If a User does not agree to the amended Terms, the User may discontinue use of the Services and cancel his or her membership registration. If the User continues to use the Services, the User shall be deemed to have agreed to the amendment of the Terms, and the amended Terms shall take effect in the same manner as set forth in the preceding paragraph.
Article 4 (Application of Related Laws)
Matters not specified in these Terms shall be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, and other relevant laws and regulations.
Chapter 2. Service Use Agreement
Article 5 (Formation of the Use Agreement)
The Use Agreement is formed upon the Company's acceptance of the User's application for use and the User's agreement to the contents of these Terms.
Article 6 (Application for Use)
An application for use may be made by the User entering his or her personal information in the application form required by the Company on the member information screen of the Service.
Article 7 (Acceptance of Application for Use)
(1) When a Member applies for use by accurately entering all the items on the application form, the Company shall accept the application for use of the Services unless there are special circumstances.
(2) The Company may decline to accept an application for use in any of the following cases:
1. Where the application is not made under the applicant's real name;
2. Where the application is made using another person's name;
3. Where the contents of the application for use are falsely stated;
4. Where the application is made for the purpose of impairing public order or good morals;
5. Where other requirements for application for use set by the Company are not met.
Article 8 (Changes to Contractual Information)
A Member shall update any changes to the information stated at the time of application for use, and the Member shall be responsible for any problems arising from failure to make such updates.
Chapter 3. Obligations of the Contracting Parties
Article 9 (Obligations of the Company)
The Company shall not disclose or distribute to any third party the personal information of a Member that it learns in connection with the provision of the Services, without the Member's consent.
However, this shall not apply where there is a request from a state agency pursuant to the provisions of laws such as the Framework Act on Telecommunications, where there is an investigative purpose relating to a crime, or where there is a request made in accordance with procedures prescribed by other relevant laws and regulations.
Article 10 (Obligations of the Member)
(1) A Member shall not engage in any of the following acts when using the Services:
1. Improperly using another Member's ID;
2. Reproducing or publishing information obtained from the Services, or providing it to a third party;
3. Infringing the copyrights of the Company, the copyrights of third parties, or other rights;
4. Disseminating content that violates public order or good morals;
5. Acts objectively deemed to be connected with crime;
6. Other acts that violate relevant laws and regulations.
(2) A Member may not engage in commercial activities using the Services, and the Company shall not be liable for any results arising from the use of the Services for commercial activities.
(3) A Member may not transfer or give to another person the right to use the Services or any other status under the Use Agreement, nor may the Member provide such rights as collateral.
Chapter 4. Use of the Service
Article 11 (Obligations of the Member)
(1) A Member shall be responsible for the maintenance and management of his or her own mail, bulletin boards, registered materials, and the like, as necessary.
(2) A Member may not arbitrarily delete or alter materials provided by the Company.
(3) A Member shall not register on the Company's website any content that violates public order or good morals, or any content that infringes the copyrights of third parties or other rights.
If such content is posted, the Member shall bear full responsibility for any consequences arising therefrom.
Article 12 (Management and Deletion of Postings)
For the efficient operation of the Services, the Company may limit the memory space, message size, retention period, and the like for Members, and may delete the registered content without prior notice in any of the following cases:
1. Where the content slanders or defames another Member or a third party and damages their reputation;
2. Where the content violates public order or good morals;
3. Where the content is deemed to be connected with criminal activity;
4. Where the content infringes the copyrights of the Company, the copyrights of third parties, or other rights;
5. Where a Member posts obscene material on the Company's website or bulletin boards, or links to obscene sites;
6. Where the content is deemed to violate other relevant laws and regulations.
Article 13 (Copyright of Postings)
The copyright of a posting belongs to the person who posted it. A Member may not commercially use materials posted on the Services, including processing or selling information obtained through the use of the Services.
Article 14 (Service Hours)
In principle, the use of the Services shall be available 24 hours a day, 365 days a year, unless there is a special operational or technical impediment. However, this shall not apply in the event of regular maintenance or similar circumstances.
Article 15 (Responsibility for Use of the Service)
A Member shall not engage in acts such as hacking, linking to obscene sites, or the illegal distribution of commercial software using the Services. The Company shall not be liable for the results of any commercial activities, losses, or legal measures by relevant authorities arising from such violations.
Article 16 (Suspension of Service Provision)
The Company may suspend the provision of the Services in any of the following cases:
1. Where unavoidable due to construction such as maintenance of service facilities;
2. Where a key telecommunications business operator as prescribed in the Telecommunications Business Act suspends its telecommunications service;
3. Where system inspection is necessary;
4. Where there is other force majeure.
Chapter 5. Termination of Agreement and Restriction of Use
Article 17 (Termination of Agreement and Restriction of Use)
(1) When a Member wishes to terminate the Use Agreement, the Member must apply for termination via the Internet in person, and the Company shall take action after verifying the Member's identity.
(2) If a Member commits any of the following acts, the Company shall notify the User of its intent at least thirty (30) days prior to the termination measure and shall give the User an opportunity to state his or her opinion:
1. Stealing another person's User ID and password;
2. Intentionally interfering with the operation of the Services;
3. Making a false application for membership;
4. Where the same user registers more than once under a different ID;
5. Disseminating content detrimental to public order or good morals;
6. Damaging the reputation of another person or committing acts that cause disadvantage to another person;
7. Transmitting a large volume of information or advertising information for the purpose of interfering with the stable operation of the Services;
8. Disseminating computer viruses or similar programs that cause the malfunction of information and communication facilities or the destruction of information;
9. Infringing the intellectual property rights of the Company, other Members, or third parties;
10. Improperly using another person's personal information, User ID, or password;
11. Where a Member posts obscene material on his or her own website or bulletin board, or links to obscene sites;
12. Where the act is deemed to violate other relevant laws and regulations.
Chapter 6. Miscellaneous
Article 18 (Prohibition of Transfer)
A Member may not transfer or give to another person the right to use the Services or any other status under the Use Agreement, nor may the Member provide such rights as collateral.
Article 19 (Compensation for Damages)
The Company shall not be liable for any damage incurred by a Member in connection with the Services provided free of charge, except where such damage is caused by the Company's intent or gross negligence.
Article 20 (Disclaimer)
(1) The Company shall be exempt from liability for the provision of the Services where it is unable to provide the Services due to a natural disaster, war, or other equivalent force majeure.
(2) The Company shall be exempt from liability for any damage arising from unavoidable causes such as the repair, replacement, regular inspection, or construction of service facilities.
(3) The Company shall not be liable for any impediment to the use of the Services due to causes attributable to the Member.
(4) The Company shall not be liable for any loss of profits expected by a Member through the use of the Services or for any damage arising from materials obtained through the Services.
(5) The Company shall not be liable for the reliability, accuracy, or other aspects of information, materials, or facts posted by a Member on the Services.
Article 21 (Jurisdiction)
In the event that a lawsuit is filed regarding a dispute arising from the use of the Services, the court having jurisdiction over the location of the Company shall be the court of exclusive jurisdiction.
Addendum
(Effective Date) These Terms shall take effect as of [Effective Date].
